MarketMate Terms of Service

MarketMate provides market information, not investment advice. Market data may be delayed, sampled, incomplete or incorrect. Do not rely on MarketMate as the sole basis for a financial or trading decision.

1. Agreement and eligibility

These Terms of Service ("Terms") are an agreement between you and Movent (Private) Limited ("MarketMate", "we", "us" or "our") and govern your use of the MarketMate applications for Android and iOS, marketmatehq.com and related services (together, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 16 years old to use MarketMate. If you are not legally able to enter a binding agreement where you live, your parent or legal guardian must review and agree to these Terms for you. You may not use the Service if applicable law prohibits you from doing so.

Our Privacy Policy explains how we handle personal information and is available in the app and on our website.

2. The Service

MarketMate displays information relating to the Pakistan Stock Exchange, including share prices, index levels, charts and news. It also allows users with an account to save a watchlist across devices. Most market-information features may be used without an account.

We may add, change, restrict, suspend or discontinue features where reasonably necessary. We may also set reasonable usage limits to protect the Service and other users.

3. No investment advice or financial service

MarketMate is an information service. It is not a broker, dealer, exchange, custodian, bank, investment platform or financial adviser. You cannot buy, sell, trade or hold securities through MarketMate, and we do not take custody of money or securities.

Nothing in the Service is investment, financial, trading, tax or legal advice. Nothing is a recommendation, solicitation, endorsement or offer to buy or sell a security, and nothing is tailored to your financial circumstances, objectives or risk tolerance.

Investing involves risk, including possible loss of money. You are responsible for your decisions. Before acting, verify information with the exchange or your broker and obtain advice from an appropriately qualified professional where needed.

4. Market data and news

Market data shown in the Service is delayed and may be sampled, derived, corrected or adjusted. It is not real-time trading data and may differ from values shown by the exchange or a broker. Unless expressly identified otherwise, a displayed value should not be treated as an official closing or settlement value.

Data and news may be unavailable, late, incomplete or incorrect because of feed interruptions, market suspensions, corporate actions, technical problems or other events. We do not guarantee the accuracy, completeness, availability or timeliness of any price, index, chart, calculation or news item. MarketMate is not a trading terminal, and you must not rely on it for order execution or time-sensitive trading.

Market data, news and related material are owned by or licensed to us or our providers. You may view them through the Service for your own personal, non-commercial use. Unless applicable law allows it or we give written permission, you may not scrape, harvest, copy in bulk, republish, redistribute, sell, sublicense or make this material available through another product or service.

News published through MarketMate is general information and is subject to the no-advice provisions above. References to an external source do not transfer ownership of that source's content to us and do not imply its endorsement of MarketMate.

5. Accounts and content you provide

To create an account, you provide an email address, username and password. You agree to provide accurate information, keep your credentials secure and notify support@marketmatehq.com promptly if you believe your account has been accessed without permission. An account is for one person and may not be sold, transferred, shared or lent.

Usernames are offered on a first-come basis. We may require a username to be changed or may reclaim it if it impersonates another person or organisation, infringes rights, is offensive, is misleading, or is reserved for operating the Service.

You remain responsible for information you submit, including support messages. You keep ownership of that content and give us a limited permission to store, process and use it only as necessary to operate, secure and support the Service. You must not submit unlawful, harmful, abusive, infringing or deceptive content.

You can request deletion of your account through the app. The account remains recoverable for 30 days and is permanently erased if you do not restore it during that period. The Privacy Policy explains what deletion covers and when limited information may be retained.

6. Acceptable use

You agree not to:

• Use the Service unlawfully, fraudulently, deceptively, abusively, for market manipulation, or in a way that harms another person.
• Access or attempt to access another person's account or any non-public part of the Service without permission.
• Disrupt the Service, overload it, evade rate limits, bypass security, introduce malicious code, or probe for vulnerabilities without our written authorisation.
• Use bots, crawlers, scrapers or other automated methods to access the Service or extract data except where we have expressly authorised it.
• Reverse engineer, decompile or disassemble the Service except where applicable law permits this despite the restriction.
• Copy, modify, sell, license or distribute the Service, use it to create a competing service or train a machine-learning model, or remove proprietary notices.
• Misrepresent your identity or affiliation with another person or organisation.

We may investigate suspected misuse and take reasonable measures to protect the Service, our rights and other users.

7. Intellectual property

The Service, including its software, design, interface, text, graphics, charts, branding and original content, is owned by or licensed to us and is protected by applicable intellectual-property law.

We give you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the app on devices you own or control and to access the Service in accordance with these Terms. No other rights are granted.

Company names, ticker symbols, trademarks and logos shown in MarketMate belong to their respective owners. They are used for identification and do not imply affiliation, sponsorship or endorsement.

If you send us feedback or suggestions, you allow us to use them without restriction or compensation, but you are not required to provide feedback.

8. Availability, notifications and termination

We aim to keep MarketMate available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, market-data interruptions, network failures, security incidents and events outside our control may affect availability.

MarketMate may send optional notifications about news, market events, market status or items you follow. Notifications can be delayed, duplicated, missed or incorrect. They are informational only, are not investment advice or guaranteed alerts, and must not be relied upon for trading or other time-sensitive decisions. You can turn notifications off in your device settings.

You may stop using the Service at any time and may request deletion of your account as described above. We may restrict, suspend or terminate access if we reasonably believe you have breached these Terms, created a security risk, harmed the Service or another person, or if we must act to comply with law. Where reasonable and lawful, we will provide notice.

Provisions that by their nature should continue after termination, including those concerning market data, intellectual property, disclaimers, liability and disputes, will remain effective.

9. Third-party services and app stores

The Service may depend on or link to third-party services or content. We do not control those services, and their terms and privacy policies may apply to your use of them.

Your use of the app is also subject to the rules and terms of the app store through which you obtained it. For the iOS app, Apple's Standard Licensed Application End User License Agreement applies in addition to these Terms unless a custom licence agreement is provided through Apple.

10. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory. We do not warrant that the Service will be uninterrupted, secure, error-free or suitable for a particular purpose, or that any information will be accurate, complete, current or reliable.

To the fullest extent permitted by law, MarketMate and Movent (Private) Limited will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profit, revenue, business, data or goodwill, or any trading or investment loss arising from the Service or your inability to use it.

In particular, we are not liable for loss caused by a decision based on information or a notification from the Service, or by delayed, inaccurate, unavailable or interrupted market data. To the fullest extent permitted by law, our total aggregate liability arising from the Service or these Terms will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation and, where applicable, death or personal injury caused by negligence.

11. Changes to these Terms

We may update these Terms when the Service or applicable law changes. We will post the updated version, revise the date above and provide additional notice of material changes where required. If you continue using the Service after updated Terms take effect, you agree to them. If you do not agree, you must stop using the Service.

12. Governing law and general terms

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules, and the courts of Lahore, Pakistan will have jurisdiction. If you are a consumer, this does not remove any mandatory protection or right to bring proceedings available under the law that applies to you.

If any provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms or your account. We may transfer these Terms as part of a reorganisation, merger, acquisition or sale of business. These Terms and any feature-specific terms presented to you form the agreement between you and us concerning the Service. Our Privacy Policy separately explains how we handle personal information.

The English version controls if a translation differs.
